Terms of Service

Overview

These Terms of Service govern access to and use of the Kemvirox™ website, online store, content, features, products, checkout functions, and related services collectively referred to as the “Services.”

The terms “Kemvirox,” “we,” “us,” and “our” refer to Chengdu Zhiyuan Yunqing Technology Co., Ltd., the operator of this store. Our online commerce platform is provided by Shopify.

These Terms incorporate by reference our Privacy Policy, Shipping Policy, Return and Refund Policy, Payment Options, and any other rules posted through the Services.

By visiting the website, creating an account, submitting information, or placing an order, you agree to these Terms. If you do not accept them, discontinue use of the Services.

Section 1 – Eligibility and Account Access

You must have reached the legal age of majority in your place of residence to use the Services independently. If you permit a minor dependent to access the Services using a device or account under your control, you are responsible for that access.

You may be required to provide an email address, billing details, shipping information, or other information when creating an account or purchasing a product. Information submitted to the store must be current, complete, and accurate.

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • Restricting unauthorized access to your account

  • Reviewing activity conducted through your account

  • Updating information when it changes

  • Notifying us if you become aware of unauthorized use

You may not sell, transfer, license, or assign your customer account to another person without our written approval.

Section 3 – Product Information

We make reasonable efforts to present product descriptions, materials, dimensions, colors, photographs, and other details accurately.

The appearance of a product may vary according to:

  • Screen type and display settings

  • Lighting conditions

  • Photography and image processing

  • Manufacturing batches

  • The natural characteristics of woven or textile materials

Measurements may have minor variations where products contain flexible fabric, stitched sections, folds, or handmade details.

Product descriptions, specifications, colors, availability, and packaging may be updated without prior notice. We may discontinue a product or limit quantities available to a customer, household, geographic area, or jurisdiction.

Nothing on the website guarantees that a product will match every personal preference, room arrangement, furniture type, or intended use.

Section 4 – Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products.

An automated order confirmation acknowledges that the order was received but does not necessarily confirm final acceptance. An order is accepted after payment authorization and our review of the purchase.

We may decline, limit, or cancel an order for reasons including:

  • Product unavailability

  • Incorrect pricing or product information

  • Payment authorization failure

  • Suspected fraud or unauthorized activity

  • Shipping restrictions

  • Excessive quantities

  • Suspected commercial resale

  • Violation of these Terms

If an order is declined or canceled after payment has been submitted, the applicable amount will be refunded to the original payment method.

Customers must review product selections, quantities, shipping details, and billing information before placing an order. Cancellation or address-change requests must be submitted within the period stated in our Shipping Policy and may not be available after processing begins.

Products purchased through the Services are intended for personal or household use unless we agree otherwise in writing.

Section 5 – Prices, Discounts, and Taxes

Unless stated otherwise, prices are displayed and processed in United States Dollars (USD).

Prices may change without notice. The amount charged for a product will be the amount displayed during checkout and recorded in the order confirmation.

Unless specifically included at checkout, listed product prices do not include:

  • Shipping charges

  • Customs duties

  • Import taxes

  • Brokerage fees

  • Currency-conversion charges

  • Other government or financial institution charges

Promotions, discount codes, and special offers may be governed by separate conditions. Promotional terms will apply if they conflict with a general provision of these Terms concerning that promotion.

We may correct pricing errors and cancel affected orders where permitted by applicable law.

Section 6 – Payment

Available payment methods are displayed during checkout and may include PayPal, eligible credit cards, debit cards, or guest card payment through a supported provider.

You represent that:

  • You are authorized to use the selected payment method

  • The payment and billing information is accurate

  • The payment provider may process the applicable charges

  • You will pay the order total and any charges disclosed during checkout

Payment information is processed by the applicable payment provider. Kemvirox does not directly store complete card numbers or card verification codes on its own systems.

Section 7 – Shipping and Delivery

Order processing periods, shipping charges, delivery estimates, tracking information, customs responsibilities, and package procedures are described in our Shipping Policy.

Delivery dates are estimates and may be affected by carriers, customs agencies, local postal services, weather, holidays, address issues, or events outside our reasonable control.

Customers are responsible for providing complete delivery information and monitoring tracking updates.

Risk of loss and ownership will transfer as required by applicable law. Nothing in these Terms limits rights that cannot legally be excluded.

Section 8 – Returns and Refunds

Returns, damaged-item requests, exchanges, cancellations, and refunds are governed by our Return and Refund Policy.

Products must not be sent back without prior authorization. The return destination may differ from the address shown on an original package or business registration record.

Nothing in these Terms limits mandatory consumer rights available under applicable law.

Section 9 – Intellectual Property

The Services and their contents—including text, product descriptions, photographs, graphics, icons, page layouts, logos, trademarks, videos, designs, and software—are owned by or licensed to Kemvirox and are protected by applicable intellectual-property laws.

You may access the Services for personal, non-commercial shopping purposes. Without written permission, you may not:

  • Copy or republish website content

  • Reproduce product images or descriptions

  • Modify or create derivative works from our materials

  • Sell, sublicense, or commercially exploit website content

  • Remove copyright or trademark notices

  • Use our content to train, populate, or operate another commercial service

No provision of these Terms transfers ownership of any Kemvirox, Shopify, or third-party intellectual property.

The Kemvirox name, logo, product names, visual identity, and related brand elements may not be used without prior written authorization.

Section 10 – Customer Content and Feedback

You may have opportunities to submit reviews, photographs, comments, suggestions, or other content collectively referred to as “Customer Content.”

You confirm that:

  • You own the content or have permission to submit it

  • The content is accurate to the extent it describes your experience

  • Any incentive or compensation connected with the submission has been disclosed

  • The content does not violate another person’s rights

  • The content does not contain unlawful material, malware, or misleading information

By submitting Customer Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, reproduce, format, publish, display, translate, distribute, and use it in connection with operating and promoting the Services.

We are not required to treat Customer Content as confidential, compensate you for it, publish it, or respond to it.

We may moderate or remove content that violates these Terms or applicable law.

Section 11 – Prohibited Conduct

You may not use the Services to:

  • Violate any law, regulation, or legal right

  • Infringe intellectual-property, privacy, or publicity rights

  • Submit false, deceptive, defamatory, or abusive content

  • Harass, threaten, or impersonate another person

  • Conduct fraud or unauthorized transactions

  • Distribute spam, chain messages, or unsolicited promotions

  • Upload viruses, malware, or harmful code

  • Circumvent access controls or website security features

  • Interfere with website availability or functionality

We may investigate suspected violations and cooperate with service providers or authorities where legally required.

The Services may contain links to websites or resources operated by third parties.

A link does not necessarily mean that we endorse, control, or verify the third party or its content. We are not responsible for external website availability, practices, products, services, or information.

Transactions made through a third-party website are between you and that provider. Review the third party’s policies before providing information or completing a transaction.

Questions or claims concerning third-party products or services should be directed to the relevant provider.

Section 14 – Shopify Platform

Shopify provides the commerce technology that enables Kemvirox to operate the online store.

Purchases made through the store are transactions directly between the customer and Chengdu Zhiyuan Yunqing Technology Co., Ltd. Shopify is not the seller of Kemvirox products and is not responsible for fulfilling orders, handling product questions, or resolving transactions between Kemvirox and its customers.

To the extent permitted by law, Shopify and its affiliates are not responsible for claims, losses, or damages arising from products purchased from Kemvirox.

Shopify’s trademarks, platform, and related intellectual property remain the property of Shopify or its licensors.

Section 15 – Privacy and Data Processing

Personal information collected through the Services is handled according to our Privacy Policy.

Because the store uses Shopify’s platform, Shopify may collect and process information relating to your access, device, transactions, and use of the Services. Information may also be shared with payment processors, fulfillment providers, carriers, analytics providers, and other service partners where necessary to operate the store.

Some service providers may process information in countries outside the customer’s place of residence.

EXCEPT FOR RIGHTS OR WARRANTIES THAT CANNOT LEGALLY BE EXCLUDED, WE DISCLAIM EXPRESS AND IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, AND NON-INFRINGEMENT.

WE DO NOT REPRESENT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ACCURATE, OR ERROR-FREE.

PRODUCT RIGHTS AND REMEDIES PROVIDED UNDER APPLICABLE CONSUMER LAW REMAIN UNAFFECTED.

Section 20 – Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KEMVIROX, CHENGDU ZHIYUAN YUNQING TECHNOLOGY CO., LTD., AND THEIR DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

THIS INCLUDES, WHERE PERMITTED, LOST PROFITS, LOST REVENUE, LOST DATA, LOST SAVINGS, BUSINESS INTERRUPTION, OR REPLACEMENT COSTS ARISING FROM USE OF OR INABILITY TO USE THE SERVICES.

WHERE LIABILITY CANNOT BE EXCLUDED, IT WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Nothing in these Terms excludes liability where exclusion or limitation is prohibited by law.

Section 21 – Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Kemvirox, Chengdu Zhiyuan Yunqing Technology Co., Ltd., Shopify, and their respective affiliates, personnel, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable legal expenses arising from:

  • Your breach of these Terms

  • Your unlawful use of the Services

  • Your infringement of another person’s rights

  • Customer Content submitted by you

  • Fraudulent or unauthorized conduct associated with your account

We may participate in or control the defense of an eligible claim. You agree to provide reasonable cooperation.

Section 22 – Governing Law and Disputes

These Terms and any separate agreement concerning the Services will be governed by the laws applicable in the jurisdiction where Chengdu Zhiyuan Yunqing Technology Co., Ltd. is registered, without limiting mandatory consumer protections available in the customer’s place of residence.

Before beginning formal proceedings, customers are encouraged to contact service@kemvirox.com so the matter can be reviewed.

Any dispute will be handled by a court or tribunal with jurisdiction under applicable law.

Section 23 – General Provisions

Severability

If any provision is found unlawful or unenforceable, it will be modified or removed only to the extent necessary. The remaining provisions will continue in effect.

No Waiver

A failure to enforce any provision does not waive the right to enforce it later.

Entire Agreement

These Terms and the policies incorporated by reference form the complete agreement governing use of the Services and replace earlier communications concerning the same subject.

Assignment

You may not transfer your rights or obligations under these Terms without our written permission.

We may transfer our rights or obligations as part of a merger, restructuring, sale, service-provider arrangement, or other lawful business transaction.

Headings

Section headings are included for organization and do not change the meaning of the provisions.

Section 24 – Updates and Contact Information

We may revise these Terms by publishing an updated version on this page.

Material changes will take effect on the date stated in the applicable notice or as otherwise required by law. Continued use of the Services after an update becomes effective constitutes acceptance of the revised Terms.
